Terms of Service

1. Agreement

These terms govern your use of ZipKit. By creating an account or using the service you agree to them. If you are agreeing on behalf of a company, you represent that you have authority to bind it.

2. The service

ZipKit provides software for recording and managing field sales activity, including voice capture, transcription, and synchronization with third-party CRMs. We may change or improve the service over time; we will not make a material reduction in functionality during a paid term without notice.

3. Your content

You retain ownership of everything you put into ZipKit. You grant us the limited right to host, process, and transmit it as needed to operate the service. You are responsible for having the rights and consents needed for the content you record, including any recording of other people.

4. Acceptable use

Do not use ZipKit to break the law, infringe others' rights, record people where doing so is unlawful, send unsolicited bulk messages, or attempt to compromise the service or other customers' data. We may suspend accounts that do.

5. Fees

Paid plans are billed in advance per seat. Trials convert to a paid plan only if you choose to continue. Fees are non-refundable except where required by law. We will give at least 30 days' notice before a price change takes effect for your organization.

6. Third-party services

When you connect a CRM or other third-party service, your use of that service is governed by its own terms. We are not responsible for a third-party service's availability or for data loss within it.

7. Termination

You may cancel at any time, effective at the end of the current billing period. We may terminate for material breach. On termination you may export your data for 30 days, after which we delete it.

8. Disclaimers and liability

ZipKit generates records from speech and may make mistakes; you are responsible for reviewing anything that matters. The service is provided "as is" to the fullest extent permitted by law. Our aggregate liability is limited to the amount you paid us in the twelve months before the claim.
